Development Update: 3057-3067 Bayview Ave and 1 Burleigh Heights Dr

Dear friends and neighbours,
Last fall, some of you took the time to attend a community meeting to learn about the development application at 3057-3067 Bayview Ave and 1 Burleigh Heights Dr. I wanted to provide you with an update on the status of this application.
This development had been appealed by the applicant to the Ontario Municipal Board (OMB), a provincial body which has final jurisdiction on development approvals. At the end of June of this year, the applicant made a confidential offer of settlement to North York City Planning staff in an effort to address concerns with the design of the townhouse project. Staff reviewed the offer and made recommendations to support a settlement through a confidential report to the July 12 and 13 City Council meeting.
Previously, the Bayview Village Association sent a letter of objection to the original application on behalf of residents. In recognition of this and the concerns heard from the community, I requested special permission for members of the BVA Executive to be consulted on the details of the confidential settlement offer before it was dealt with by City Council. While we did have substantial correspondence with the BVA on the item, my office did not receive a definitive response on whether they wished to continue with the appeal or accept the offer of settlement.
This was the last City Council meeting before the scheduled OMB appeal hearing on Sept. 27, so it was necessary that a report for direction on the settlement come to this session. The report's options were to decide whether to pursue the appeal process through the OMB, or support the City Staff recommendations to accept the negotiated settlement.
As some of you may know, at a recent OMB hearing for a 14-storey condo at 3237 Bayview Ave, the Board sided with the applicant despite strong objections from the City. As a result, the project did not see significant compromises and no community benefits for the area were secured. Given that City Legal and City Planning Staff were satisfied and were recommending support of the current offer, and in light of recent decisions in this area by the OMB, I felt the better option was to support the settlement recommendations made by City Staff.
